1. Acceptance of Terms

Welcome to eNadapuram! These Terms of Service ("Terms") govern your access to and use of the eNadapuram mobile application and website (collectively, the "Platform").

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Description of Services

eNadapuram is a local service platform that connects users in the Nadapuram region with various services including:

• Home Delivery Services: Fresh groceries, vegetables, meat, seafood, and daily essentials
• Digital Services: Documentation, typing, form assistance, bill payments, printing, and scanning
• Cleaning Services: Deep cleaning, kitchen and bathroom cleaning, floor polishing, and maintenance
• Laundry Services: Wash and fold, dry cleaning, ironing, and home pickup/delivery
• Manpower Services: Skilled and unskilled labor, event support, and temporary workers
• Government Service Updates: Information sharing about PSC, NORKA, scholarships, and e-District services

eNadapuram acts as an intermediary platform connecting users with independent service providers. We do not directly provide these services ourselves.

3. Eligibility

To use our Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Reside in or be located within our service area (Nadapuram and surrounding regions)
• Comply with all applicable laws and regulations

By using our Platform, you represent and warrant that you meet all eligibility requirements.

4. User Account and Registration

4.1 Account Creation

To access certain features, you must create an account by providing:

• Valid email address
• Mobile phone number
• Delivery address
• Panchayat area information

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information remains accurate and up-to-date

4.3 Account Restrictions

You may not:

• Create multiple accounts
• Share your account with others
• Use another person's account without permission
• Sell, transfer, or assign your account

5. Acceptable Use

5.1 Permitted Use

You may use our Platform only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Activities

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code, viruses, or harmful materials
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Platform's operation
• Harass, abuse, or harm other users or service providers
• Post false, misleading, or fraudulent information
• Use automated systems (bots, scrapers) without permission
• Engage in any commercial use without our written consent

6. Government Services Disclaimer

6.1 What We Do

• Share information and updates about government services (PSC, NORKA, scholarships, e-District)
• Provide a platform to book assistance services
• Connect users with local experts who can help with forms and documentation
• Offer guidance and information resources

6.2 What We Do NOT Do

• We do NOT submit applications on your behalf to any government portal
• We do NOT process government applications or requests
• We do NOT guarantee approval of any government application
• We are NOT authorized agents of any government department
• We do NOT have special access to government systems or databases

6.3 Your Responsibilities

When using government service information through our Platform, you must:

• Verify all information from official government sources
• Submit all applications yourself through official government portals
• Ensure accuracy of all information you provide
• Comply with all government rules, regulations, and deadlines
• Understand that eNadapuram is not responsible for application outcomes

6.4 Official Government Portals

7. Orders and Payments

7.1 Placing Orders

When you place an order through our Platform:

• You are making an offer to purchase goods or services
• Order confirmation constitutes our acceptance of your offer
• Prices are subject to change without notice until order is confirmed
• We reserve the right to refuse or cancel any order

7.2 Payment Methods

We accept the following payment methods:

• Cash on Delivery (COD)
• Online payment via UPI, credit/debit cards, and digital wallets

7.3 Pricing and Fees

• All prices are in Indian Rupees (INR)
• Prices include applicable taxes unless otherwise stated
• Delivery charges may apply based on location and order value
• Service charges may apply for certain services

7.4 Payment Processing

For online payments:

• Payments are processed through secure third-party payment gateways
• You authorize us to charge your selected payment method
• Payment must be received before service delivery (unless COD)
• Failed transactions will result in order cancellation

8. Cancellations and Refunds

8.1 Order Cancellation

By User:

• You may cancel orders before they are confirmed or dispatched
• Cancellation may not be possible once order is out for delivery
• Contact support immediately for cancellation requests

By eNadapuram:

• We may cancel orders due to unavailability of items/services
• Technical errors or pricing mistakes
• Suspicious or fraudulent activity
• Force majeure events

8.2 Refund Policy

Eligible for Refund:

• Orders canceled before dispatch
• Non-delivery of ordered items
• Significantly defective or damaged products
• Wrong items delivered
• Payment processing errors

Refund Processing:

• Refund requests must be made within 24 hours of delivery
• Refunds will be processed to the original payment method
• Processing time: 5-7 business days for online payments
• COD orders: refund via bank transfer (provide bank details)

Non-Refundable:

• Services already rendered
• Perishable goods (unless defective)
• Change of mind after delivery
• Assistance services already provided

9. Service Providers

9.1 Third-Party Services

Service providers on our Platform are independent contractors, not employees or agents of eNadapuram.

9.2 Provider Verification

While we verify service providers, we do not guarantee:

• Quality or accuracy of services provided
• Availability of providers at all times
• That providers will meet your specific requirements

9.3 Direct Relationship

When you book a service:

• A direct contractual relationship is formed between you and the provider
• eNadapuram facilitates the connection but is not party to the contract
• Disputes should be resolved directly with the provider
• We may assist in dispute resolution but are not obligated to do so

9.4 Provider Issues

If you experience issues with a service provider, please:

• Report it through the app immediately
• Provide details and supporting evidence
• We will investigate and take appropriate action
• Serious violations may result in provider removal

10. User Content and Conduct

10.1 User Reviews and Ratings

You may post reviews and ratings, but you agree:

• Reviews must be honest and based on personal experience
• No false, misleading, or defamatory content
• No offensive, abusive, or inappropriate language
• No spam or promotional content
• We reserve the right to remove or edit reviews

10.2 User-Generated Content

By posting content on our Platform, you grant us:

• A non-exclusive, worldwide, royalty-free license to use, display, and distribute your content
• The right to moderate, edit, or remove content at our discretion

10.3 Intellectual Property

You retain ownership of content you post, but you represent and warrant:

• You own or have rights to the content
• Content does not infringe third-party rights
• Content complies with applicable laws

11. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Platform, you consent to:

12. Limitation of Liability

12.1 To the Maximum Extent Permitted by Law:

eNadapuram and its officers, directors, employees, and agents shall NOT be liable for:

• Indirect, incidental, special, consequential, or punitive damages including but not limited to:
  • Loss of profits or revenue
  • Loss of data or information
  • Business interruption
  • Loss of goodwill or reputation
• Service provider actions: Quality, safety, or legality of services provided by third-party providers
• Product quality: Quality, freshness, or safety of products delivered
• User conduct: Actions or omissions of other users
• Government applications: Any outcomes related to government applications or services
• Service interruptions: Temporary unavailability or technical issues
• Third-party content: Accuracy or reliability of information from external sources

12.2 Maximum Liability

Our total liability to you for all claims arising from or related to our services shall not exceed the amount you paid to us in the six (6) months preceding the claim, or ₹1,000 (whichever is less).

12.3 Basis of Bargain

These limitations reflect the allocation of risk between the parties. The limitations will apply even if we have been advised of the possibility of such damages and even if any remedy fails of its essential purpose.

13. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, reliability, or completeness of content
• Uninterrupted, timely, secure, or error-free service
• Results obtained from using the Platform
• Quality of products or services obtained through the Platform

We do not warrant that:

• The Platform will meet your requirements
• Defects will be corrected
• The Platform is free from viruses or harmful components
• Service providers will perform as expected

14. Indemnification

You agree to indemnify, defend, and hold harmless eNadapuram, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

• Your use or misuse of the Platform
• Violation of these Terms
• Violation of any rights of another person or entity
• Your content or conduct
• Any transaction or dispute with service providers
• Any government application or service-related matters
• Breach of any representation or warranty made by you

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you.

15. Termination

15.1 Termination by You

You may terminate your account at any time by:

• Contacting our support team
• Following the account deletion process in the app

15.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent, illegal, or abusive conduct
• Non-payment of fees
• Request by law enforcement or government agency
• Prolonged inactivity
• Technical or security reasons

15.3 Effect of Termination

Upon termination:

• Your right to use the Platform immediately ceases
• We may delete your account and all associated data
• Outstanding payments remain due
• Sections of these Terms that by their nature should survive will survive

16. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of this page
• For material changes, we will provide notice through the app or via email
• Continued use of the Platform after changes constitutes acceptance
• If you don't agree with changes, you must stop using our services

It is your responsibility to review these Terms periodically.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

17.2 Jurisdiction

Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Nadapuram, Kerala, India.

17.3 Dispute Resolution

Before filing any legal action, we encourage you to:

• Contact our support team to resolve the issue informally
• Provide a detailed description of the dispute
• Allow us 30 days to attempt resolution

19. Miscellaneous

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and eNadapuram regarding the Platform.

19.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

19.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

19.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, pandemic, strikes, or government actions.

19.6 Language

These Terms are provided in English. In case of any conflict between English and translated versions, the English version shall prevail.

19.7 Notices

Acknowledgment

BY USING THE ENADAPURAM PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTOOD THEM, AND AGREE TO BE BOUND BY THEM.

If you do not agree to these Terms, you must not access or use our Platform.
